Chapter 13 is most commonly used to stop a home foreclosure, protect a co signer, or bankrupt certain debts that could not be bankrupted in a Chapter 7 bankruptcy.   A Chapter 13 can be used for several reasons:

  1. Alimony and child support that cannot be discharged can be repaid in a Chapter 13.   Child Support arrearage owed to the state may be subordinated under certain conditions in a Chapter 13.     
  2. Co signers are completely protected in a Chapter 13 if the plan repays 100%.       
  3. Second mortgages that have no equity can be paid back in a Chapter 13 bankruptcy at the same rates as the unsecured credit cards and these second mortgages are removed on the completion of payment of the plan.       
  4. Chapter 13 cases may be paid off early and there are also early and hardship discharges but for the details you must work with your Chapter 13 attorney.      
  5. It is also possible to refinance your home to a lower rate while in a Chapter 13.  It is even possible to purchase a home while in a Chapter 13 after you have paid all of your debts, including your Chapter 13 payment, on time for at least 12 months.       
  6. Other Debts may get a super discharge in a Chapter 13 when they would otherwise would not have been bankruptable in Chapter 7.   
  7. Debts can also be reviewed with your attorney and claims objected to so that many of them are eliminated.     
  8. A Chapter 7 may not be possible if a person has filed a prior Chapter 7 within the last 8 years.
